actually king fowley can tell you about this issue. He bootleged many albums with no permission of the rights holders, the companies I mean. The bands have the rights of the writting not the production, unless they pay for it all.

Unisound is a bullshit, bootleg label and they give other legit greek re-issue labels like Arkeyn Steel and Steel Legacy, etc. a bad name. I wouldn't believe a word they tell you unless they can show you actual proof of such licensing contracts. They even bootleg greek bands, for fuck sakes... I have to admit that I am guilty of owning a copy of that Ra Pariah CD, but if another label is LEGALLY re-issuing the material, the minute it comes out, I am placing an order and throwing the Unisound boot into the trash.

you're wrong about this. i mean the greek bands. ask arkeyn steel how much unisound gave to vavel, for example, in order to reissue their stuff+the unreleased lp. and thus it didn't come from steel gallery as it was the initial plan.

I could really care less about this as I own all of the originals...

How about Varney re-issues some of the Shrapnel back catelog that has never before been legally pressed on CD format.

Blitzkrieg, Ravage, Trauma, etc.

Unisound does have a couple legit pressings, but the majority of what they put out is illegal.

ha, i have all apocrypha on all versions. actually the cds+japanese pressings i got them from stockholm, in one great cd store in malmsteensgatan(or something like this, near the opera house). tons and tons of japanese pressings in this godly store (with the usual multicolor stamps on every cd  ) etc.

as for the other, i assuming that from the moment apocrypha is scheduled, soon the others will follow.....i can't ask varney, coz the last time i was mad at him for releasing macalpine and moore collections without putting some unreleased or other versions of trax in them....

Basically if a label has paid for a recording they own the rights to it- similarly if a band has signed away their rights/ copyright to songs or albums the label still technically owns it irrespective if they have gone under or not. The only time it will revert back to the band is if the contract had a stipulated number of years for the term of contract rather than 'in perpetuity' written on it. Obviously if a label has gone bust then they can't exactly do anything about it if someone puts out the stuff- and I wouldn't exactly hold it against a band trying to get their stuff reissued and actually seeing some money from it rather than someone just putting out a bootleg, but legally they are in the wrong. Extinct labels do get bought from time to time, and the rights get bought with them.

Well, I guess it's not that easy for a hard rocker (be it a guitar genius) becoming a prophet in your own town. Still it's quite a good idea as Malmskillnadsgatan has (/had - I am old) a reputation of being where to find street hookers in the Swedish capital (back when it was legal - the buying, not the selling - and no, I am not that old!).

this was the name of the street? or just joking? i remembered that i was planning to visit the swedish academy that day for a lovely lunch with my wife(we ordered 1945's menu) and i had to come back to the hotel to get some cash 'cause i spent them all in this cd store.

Heavy Sound Rock Shop is (was?) located at Malmskillnadsgatan. No joke.

Our wives have some common interests - she'll still be telling me about me burning most of our vacation budget on records in Budapest back in 2000...

I rather spend my vacations with my brother nowadays (sort of).

Not much to add.

Remember that the copyright of a sound recording and the copyright of the music and lyrics for a song are distinct. The first is applicable to a recording contract, and the second to a publishing contract. The revenue potential on each are to a great extent distinct in theory, although they do overlap. Especially when a shady label tricks a band into handing over the second set of rights, under what is known as the "one-line publishing contract" that often hides in low-tier recording deals.

And if a business folds, their assets, whether physical or intellectual property, will be divided amongst their creditors. For example Nine Inch Nails' "Pretty Hate Machine" album is owned by some big US bank that took over TVT's IP assets following its collapse.

1) If a band rights a song (but doesn't copyright it for themselves) and signs to a label (and the label copyrights all the songs under there name)
AND the band signs ALL the rights away for any use of these songs to said label.

Can the band ever release these songs on there own without getting the OK from the label???????

If they do release it without the concent of the label (Copyright holder) is it a BOOT???
And to answer these original questions: NO (at least not legally), and YES.
